Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChatCraft ("ChatCraft", "we", "us", or "our"), including our websites, dashboards, APIs, widgets, integrations, and related services (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service description

ChatCraft provides tools to create, configure, host, and operate AI-powered chatbots for websites, Discord, and other channels we support. Features may include hosted inference, analytics, knowledge-base ingestion, billing, and third-party integrations. We may modify, suspend, or discontinue parts of the Service (including beta features) with reasonable notice where practicable.

2. Eligibility and accounts

You must be legally able to enter a binding contract in your jurisdiction. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly at feedback@chatcraft.app if you suspect unauthorised access.

3. User responsibilities and acceptable use

You are solely responsible for your bots, prompts, training data, uploaded documents, integrations, and end-user interactions. You must not use the Service to violate applicable law, infringe intellectual property or privacy rights, distribute malware, harass individuals, generate non-consensual intimate imagery, facilitate fraud, or attempt to gain unauthorised access to our systems or third-party systems. You must not reverse engineer the Service except where mandatory law allows. You represent that you have the rights and consents needed to process data you submit to the Service.

4. Plans, payment, and taxes

Paid plans are billed via our payment processor (Stripe) according to the prices and billing cycle shown at checkout. Unless stated otherwise, subscriptions renew automatically until cancelled. You authorise us and Stripe to charge your payment method for applicable fees and taxes. If payment fails, we may suspend paid features or your account after notice where required. You are responsible for providing accurate billing information.

5. Refunds and cancellations

You may cancel your subscription through the billing portal where available. Unless required by law or expressly stated at purchase, fees are generally non-refundable for partial billing periods. If you believe a charge is in error, contact us within 14 days at feedback@chatcraft.app.

6. Data usage and privacy

Our processing of personal data is described in the Privacy Policy. By using the Service, you acknowledge that content you submit may be processed by us and subprocessors (including AI providers) to operate the Service. You are responsible for providing any required notices to your end users and for obtaining lawful bases where applicable.

7. API usage, rate limits, and fair use

API access, message quotas, bot limits, document limits, and other usage caps depend on your plan and may change with notice. You must not circumvent limits, overload infrastructure, or use automated means in a way that harms the Service or other customers. We may throttle, suspend, or terminate access that we reasonably believe violates fair use or threatens stability or security.

8. Intellectual property

ChatCraft and its branding, software, and documentation are owned by us or our licensors. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal or commercial chatbot use cases. You retain rights in your own content; you grant us a licence to host, process, and display it as needed to provide the Service.

9. Third-party services

The Service may integrate with third parties (for example authentication, payments, hosting, AI model providers, Discord, and storage). Those services are governed by their own terms and policies. We are not responsible for third-party outages or changes.

10. Account suspension and termination

You may stop using the Service at any time. We may suspend or terminate your account if you materially breach these Terms, create legal or security risk, or if we discontinue the Service. Upon termination, your right to use the Service ceases; provisions that by nature should survive (including payment obligations accrued, disclaimers, and liability limits) will survive.

11. Disclaimers

The Service and AI outputs are provided on an "as is" and "as available" basis. AI responses may be inaccurate or incomplete. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, ChatCraft and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, goodwill, or data. Our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the three months before the event giving rise to liability, or (b) one hundred British pounds (GBP 100), if you have not paid fees. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.

13. Indemnity

You will defend and indemnify ChatCraft and its affiliates, officers, and employees against third-party claims and costs arising from your use of the Service, your content, your bots, or your violation of these Terms or law, except to the extent caused by our wilful misconduct.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in England and Wales will have exclusive jurisdiction subject to those mandatory rules.

15. Changes

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. Where changes are material, we will provide additional notice (for example by email or in-product notice). Continued use after the effective date constitutes acceptance of the updated Terms.
